Booking Photo Rules in Klamath County
Oregon passed HB 3273 in 2021. It took effect January 1, 2022. This law restricts how jail mugshots are released in Klamath County and across Oregon. Law enforcement can no longer post booking photos on public websites. They cannot share them freely with the general public before a person is convicted.
Under HB 3273, Klamath County jail mugshots may only go to the person in the photo, law enforcement for official purposes, crime victims, court parties in the case, or the public after a conviction. These limits apply to every booking at the Klamath County Jail. The law was passed to protect people who are arrested but not yet convicted. Many people who are booked never face charges. Others are found not guilty at trial. Publishing their jail mugshots was seen as harmful to those individuals.
Before 2022, some Oregon jails displayed booking photos on public roster pages. That practice ended statewide. The Klamath County Sheriff now keeps jail mugshots off public tools. The rest of the booking record stays public. Names, charges, bail, and dates are still accessible. Only the photo itself is restricted in Klamath County.
Note: Booking photos taken before January 1, 2022, may be handled differently than those taken after the law took effect in Klamath County.
